How long is EB-1 Green Card valid?

Once your green card is approved it will be mailed to your US address.

Your green card is forever as long as you:

  • don’t commit a crime worthy of deportation
  • don’t commit immigration fraud
  • don’t commit application fraud
  • don’t stay out of the USA for longer than 6 months (more below)
  • don’t ever claim to be a citizen
  • pay your taxes
  • submit your renewal paperwork in a timely manner

This is a permanent residence card so you are required to fulfill that role. Abandoning your green card can result in you having your green card cut up by Custom and Border Patrol. To avoid this you can apply for the [2 year Reentry Permit].

On the EB-1 green card and NIW you are permitted to apply for citizenship after 5 years if you have been a permanent resident. This is different for a spousal green card, 3 years. Check [Our Citizenship Guide here].
